WEPCO filed a Petition for Rehearing in PSCW docket 6630-FR-101 because FERC, in Docket No. EL07-86-005, et al., issued an Order Granting Rehearing in Part and Denying Rehearing in Part. 127 FERC ΒΆ 61,121. The Order revisits various issues pertaining to MISO’s efforts to collect RSG costs in its rates. The Order reversed a part of FERC’s previous position and the Order provides that “The Midwest ISO is hereby directed to cease the ongoing refund process, and to reconcile the amounts paid and the amounts collected herein so that each participant is returned to the financial position it was in before the refund process began.”
WEPCO states in its petition that “Wisconsin Electric is now in the position of having been ordered by the Commission to refund to customers $10 million in putative RSG resettlement amounts that Wisconsin Electric may not receive from MISO.”
The only contested issue in the ordered refunds was the treatment of revenue sufficiency guarantee (RSG) costs associated with FERC’s November 2008 order on MISO RSG billings. Since that decision, FERC has reconsidered its November decision and it will likely impact the amount of refund the utilities receive for the period of April 25, 2006 through September 22, 2008, though it may not ultimately affect the total amount of refund received by the utilities. Given the FERC order, the Commission determined deferral accounting for these costs is appropriate.
